A member of Omoyele Sowore’s defence team, Treasure Adefisoye, on Monday told the Federal High Court in Abuja that she was not conversant with the Evidence Act, after the prosecution challenged her attempt to tender printouts of online reports in the cyber-bullying trial of the publisher.

Adefisoye, who is on the legal team led by Olumide Fusika, SAN,  had sought the leave of the court to tender the printouts, which purported that the Department of State Services, DSS, was considering pausing Sowore’s trial until after the January 16, 2027 presidential election.

Lead prosecution counsel Akinlolu Kehinde, SAN, objected to the admissibility of the documents and asked the defence lawyer whether she was aware of the provision of Section 83(3) of the Evidence Act. She answered in the negative.

Kehinde then asked her to read the section aloud. As read in court, the provision states that a document made during the pendency of a matter cannot be tendered in evidence in that same matter.

Sowore, the presidential candidate of the African Action Congress, recently opened his defence in the charge filed by the DSS, which accuses him of cyber-bullying President Bola Tinubu over an August 2025 post on his social media handles in which he described the President as a “criminal.”

In another development at Monday’s sitting, Justice Muhammad Umar adjourned to Tuesday to rule on the prosecution’s objection to a defence move to call its lead prosecuting counsel by subpoena to testify as a witness for Sowore.

The prosecution argued that the subpoena was in bad faith, diversionary and contrary to the law and to all known judicial practice. The defence maintained its position, and the judge reserved ruling after hearing both sides.
