The Court of Appeal sitting in Lagos State has nullified the election of Denis Agbo of the Labour Party as a member representing Udenu/Igboeze North Federal Constituency of Enugu State.
The court delivered its judgment on Friday via Zoom, ruling on the appeal of the All Progressives Congress candidate, Oby Ajih.
The court mandated the Independent National Electoral Commission to conduct a fresh election within 90 days for all parties involved.
Ajih had approached the appellate Court, challenging the ruling of the tribunal that the election did not follow the right process as the logo of her party wasn’t in the EC8A form.
The Apex Court, in a judgement that lasted less than 30 minutes, agreed that the appeal had merit and set aside the judgement of the tribunal.
It ruled that the non-inclusion of the APC logo in the result sheet is not in compliance with the electoral act.
