Court dissolves four-year-old marriage by “Khuli”

A Grade I Area Court in Kubwa, Abuja, has dissolved a four-year-old marriage between Hanatu Abdulaziz and her husband, Idris Haruna by “Khuli”.

Crediblenews reports that khuli is a process in Islam through which a woman divorces her husband by returning the dowry and everything she had received from him while living together.

A divorce-seeking woman may, however, not return anything, as agreed to by the estranged spouses or the judge.

The Judge, Mohammed Musa, dissolved the marriage according to Islamic Law, following Abdulaziz’s prayer for divorce by khuli on grounds of dislike.

Musa ordered Abdulaziz to refund the N20,000 dowry earlier paid on her to Haruna.

He quoted the book of Fawakihu Dawani, the interpretation of Risala, Volume 2, page 62, as stating that a divorce through “khuli” was irrevocable.

The judge further said for the respondent to send his brother, Haruna Jamilu, as his representative to court to consent to the divorce was the first divorce, once the dowry is collected, it becomes the second divorce from the husband.

He also backed the assertion with the book of Khirshi’s interpretation of Mukhtasar, Volume 4, page 22, as the authority guiding it.

Abdulaziz  had initially told the court that she got married to Haruna under Islamic Law in January 2020 and that the marriage was blessed with a one-year-old daughter.

She, however, told the court that she was tired of the way her husband treated her and begged the court to dissolve the marriage through khuli.

“I am ready to refund the dowry of N20,000 to the respondent,’’ she said.

The respondent, however, sent a letter of absence to the court, explaining that he could not appear in person due to unforeseen circumstances.

He, however, sent his brother as his representative in court.

The respondent consented to the divorce and wished the plaintiff well.
