The Presidential Election Petition Court has dismissed a petition filed by the Action Alliance party, its Presidential candidate, Solomon David Okanigbuan challenging the declaration of Bola Tinubu as the winner of the February 25 Presidential election.
Chairman of the panel of Justices of the Court of Appeal, Justice Haruna Simon Tsammani dismissed the petition following the sudden withdrawal by the party.
At the commencement of the pre-hearing session of the Presidential Election Petition Court sitting in Abuja on Monday, counsel to the petitioners, Oba Maduabuchi, SAN, moved a motion for the withdrawal of the petition.
He said that Tinubu, the All Progressives Congress, APC, and the Independent National Electoral Commission, as well as others, had served him with no objection responses.
The development was confirmed by Chief Wole Olanipekun, SAN, who stood for Tinubu and Prince Lateef Fagbemi, SAN, representing APC.
Justice Tsammani dismissed the petition in its entirety following no objections from all the respondents.
The petition has become the first to be thrown out by the Court.
