Abba Kyari remains in custody despite N50m bail

Justice James Omotoso of the Federal High Court in Abuja has stated that the final release of the embattled Deputy Commissioner of Police, Abba Kyari on bail would depend on developments in a sister case in which he was charged with drug related offences.

The National Drugs Law Enforcement Agency, NDLEA had filed a 24-count charges against Kyari and two siblings, Mohammed Baba and Ali before the court over his failure to declare properties allegedly linked to him in the asset form.

The charges claimed Kyari on February 14, 2022 failed to declare to the NDLEA property at Plot 1927 Blue Fountain Estate, Karsana, Abuja; an Estate at Linda Chaulker Road, Asokoro extension, Abuja, a plaza under construction.

The judge had earlier granted bail to Kyari brothers that were accused of receiving money from an international scam syndicate linked to Ramoni Abbas a.ka. Hushpuppi.

However, in his ruling on Thursday, justice Omotoso granted bail to Kyari, in the sum of N50m and two sureties in like sum.

Omotoso added that the sureties must have property worth N25m within Abuja. And however adjourn the case to October 18.

He further held that his release warrant in respect of the case before him, will only be signed if the other pending criminal cases are concluded or that he is granted bail in those cases.

Justice Emeka Nwite of the Federal High Court Abuja, who is handling the second case had refused to grant bail to Kyari and his co-de­fendants.

Kyari is being prosecuted before Justice Nwite on cocaine-related charges alongside four members of his former police unit, the Intelligence Response Unit.

The four other police officers are an Assistant Commissioner of Police, Sunday Ubua; an Assistant Superintendent of Police, Bawa James; Inspector Simon Agirgba; and Inspector John Nuhu.

Two civilians: Chibunna Umeibe and Emeka Ezenwanne, who were also arrested over the charges at the Akanu Ibiam International Airport, Enugu, have been jailed by the court after they pleaded guilty
