An Oyo State High Court in Ogbomoso has approved a stay of execution for the nullification of the appointment of the Soun of Ogbomoso, Oba Ghandi Olaoye.
This decision follows the court’s earlier nullification of Oba Olaoye’s appointment due to procedural flaws in his nomination process.
The presiding judge, Justice Kareem Adedokun issued the stay of execution order in suit no HOG/27/2022 on Monday. The directive instructs all parties involved to maintain the status quo ante until the appeal, already filed by Oba Olaoye’s defense and Oyo State Government, is heard and determined.
The legal battle unfolded after Oba Olaoye’s installation on September 8, 2023, was challenged in court by Prince Kabir Olaoye, citing a breach of the nomination process. On October 25, the court ruled in favor of Prince Kabir Olaoye, leading to the nullification of Oba Olaoye’s appointment.
Both the monarch and the State Government, which had initially approved the nomination, filed separate appeals. They argued that there were contradictions in the judgment, pointing to an earlier ruling on October 3, where the judge deemed the nomination process as right, proper, and valid. The appeal hearing is pending.
With the grant of the stay of execution motion, Oba Olaoye’s reign is temporarily reinstated.
It’s noteworthy that Oba Olaoye is currently abroad due to ongoing renovations in the palace.
