In a high-stakes hearing on Tuesday, Judge Juan Merchan will decide whether to dismiss President-elect Donald Trump’s New York criminal conviction, a ruling that could significantly impact Trump’s transition to the White House.

Trump, convicted of 34 felony counts in May for allegedly falsifying business records to conceal a payment to an adult film star before the 2016 election, is scheduled for sentencing on November 26. However, his legal team argues that a recent Supreme Court ruling on presidential immunity should lead to the case’s dismissal.

The Supreme Court’s landmark decision, which held that presidents are broadly immune from prosecution for official acts, could serve as a key factor in Judge Merchan’s ruling. Trump’s attorneys contend that, as president-elect, the case should be dismissed, citing the Supreme Court’s interpretation of presidential protections.

If the judge dismisses the case, Trump, who is 78, would avoid sentencing. Otherwise, his defense team is expected to delay proceedings, arguing that any sentencing could interfere with his role as president. Trump, who is due to be inaugurated on January 20, has labeled the case a “witch hunt.”

The case has sparked nationwide debate, with some urging accountability and others viewing it as politically motivated. An editorial in the *Kansas City Star* even suggested that Trump should be sworn in while serving a jail sentence if convicted, to send a strong message about the rule of law.

Trump’s former Attorney General, Bill Barr, however, criticized the New York case and others as politically driven, asserting that continued pursuit would only serve to distract the nation and incoming administration.

Meanwhile, Trump faces two federal cases led by Special Counsel Jack Smith—one concerning his efforts to overturn the 2020 election and another regarding the alleged mishandling of classified documents. Trump’s attorneys believe that his presidential status could grant him authority to dismiss or halt these cases. Smith has reportedly started to wind down these investigations, but some analysts worry that Trump’s return to office may grant him effective immunity.

Randall Eliason, a former prosecutor, voiced concerns that if Trump’s conviction is dismissed, it could be “a severe blow to the rule of law,” especially as his comeback has already overturned expectations. Trump’s resounding electoral victory was followed by several political shifts, including Joe Biden stepping down as the Democratic nominee and Kamala Harris taking his place, marking the first time a woman of color has represented a major U.S. party.

The judge’s decision will likely mark a critical moment in U.S. history, setting precedents for presidential immunity and accountability in office.
