A Magistrate Court in Sabo-Yaba, Lagos on Tuesday discharged Abdulazeez Fashola (alias Naira Marley) and his associate Samson Eletu (alias Samlarry) in connection with the death of Nigerian artist Ilerioluwa Alogba (alias Mohbad).

The court ruled that instead, Nurse Feysayo Ogedengbe and Ayobami Sadiq should face prosecution for Mohbad’s death due to alleged recklessness and negligence.

Magistrate Mrs. E. Kubeinje explained that the ruling was based on the advice of the state’s Department of Public Prosecution, DPP, signed by Dr. Babajide Martins.

She stated that the DPP had advised the court to strike out the charges against Naira Marley, Samlarry, Owodunni Ibrahim (alias Primeboy), and Mohbad’s manager, Babatunde Opere, due to insufficient evidence linking them to Mohbad’s death.

The magistrate acknowledged that while an unlawful assault had been committed by Naira Marley, Samlarry, Opere, and Primeboy on Mohbad, it did not rise to the level of criminal responsibility.

She also pointed out that Mohbad had withdrawn his previous assault complaint against Naira Marley, filed on October 11, 2022, citing an amicable settlement.

As a result, the court ruled that the aforementioned defendants had no case to answer.

The court ordered that Ogedengbe and Sadiq be prosecuted for reckless and negligent acts, in violation of Section 251(e) of the Criminal Laws of Lagos State, 2015.

The magistrate also instructed that Naira Marley, Samlarry, Primeboy, and Babatunde be released if still in custody.

The case was adjourned until March 24 for an update following the ruling.
