The Federal Government has brought criminal charges against former Kaduna State Governor, Malam Nasir El-Rufai over allegations linked to national security violations.
El-Rufai was arraigned before the Federal High Court in Abuja on accusations of unlawfully intercepting phone communications belonging to the National Security Adviser.
Court filings indicate that the 65-year-old politician is being prosecuted in connection with remarks he allegedly made during an appearance on Arise TV’s Prime Time programme on February 13, 2026. In that interview, he was said to have acknowledged involvement in the interception of the NSA’s phone communications and admitted awareness of individuals responsible for the act without notifying appropriate security agencies.
The case marked TABU DET CR/99/2026, comprises three counts.

In the first count, prosecutors alleged that El-Rufai admitted during the television interview that he
and his associates unlawfully intercepted the NSA’s communications, an offence said to contravene Section 12(1) of the Cybercrimes (Prohibition, Prevention, etc.) Amendment Act, 2024.
The second count accuses him of failing to report individuals he allegedly knew were involved in the unlawful interception, an action prosecutors argue violates Section 27(b) of the same law.
The third charge alleges that he deployed technical systems capable of undermining public safety and national security, contrary to Section 131(2) of the Nigerian Communications Act, 2003. The prosecution claims the alleged actions could cause widespread concern among citizens.
A team of Federal Government counsel, including ME Ernest, OM Owan, UM Bulla, CS Eze and VE G. Orubor is leading the prosecution.
