Nigerians face stricter visa limits by Washington

The United States, US, Department of Homeland Security, DHS, has introduced a new proposed rule that would place  fixed time limits on visas issued to  Nigerians and other international students, exchange visitors and foreign journalists, marking another move in President Donald Trump’s broader immigration enforcement agenda.

According to a government notice published on July 16, the proposed regulation would replace the current system, which allows holders of F visas for students, J visas for cultural exchange participants and I visas for foreign media professionals to remain in the United States for the duration of their academic programmes or employment.

The rule is expected to take effect 60 days after its publication in the Federal Register, subject to congressional review.

The proposal comes as the Trump administration continues to tighten immigration policies after the president’s return to office in January 2025.

Since then, the administration has increased scrutiny of legal immigration, including the revocation of some student visas and green cards linked to university students’ political views, as well as moves to end the legal status of hundreds of thousands of migrants.

Under the proposed changes, F and J visa holders would be allowed to remain in the United States for a maximum of four years. Foreign journalists holding I visas, whose stays are currently not subject to a fixed duration, would face a limit of 240 days, while Chinese journalists would be restricted to 90 days.

DHS said affected visa holders would still have the option to apply for extensions if they need additional time in the country.

The department said the proposed changes were driven by the growing number of foreign nationals entering the United States under these visa categories.

According to DHS data, more than 1.8 million student visa admissions were recorded in 2024, representing an 11% increase from the previous year. In the 2024 fiscal year, which began on October 1, 2023, the US also issued visas to more than 500,000 exchange visitors and 37,300 foreign media professionals.

Explaining the move, the department said the increase in visa holders “poses a challenge” to its ability to effectively monitor and oversee non-immigrants while they’re in the United States.

DHS added that it had identified cases of students and exchange visitors remaining in the country for decades under the existing system, which does not impose a specific end date.

Under the proposed regulation, individuals who wish to stay beyond their approved period would be required to apply for an extension through DHS or leave the United States and seek approval to re-enter.

The proposed rule is expected to affect thousands of international students, exchange participants and journalists, including Nigerians studying or working in the United States, if it becomes law.
