Court remands father for defiling daughter, spreading HIV

The accused committed the offence at Umudala village in Anambra State

The Children, Sexual and Gender-based Violence Offences Court in Awka, Anambra, has remanded a 46-year-old bricklayer, Rapuruchukwu Ezenandu, who allegedly defiled his 17-year-old daughter and infected her with HIV.

The defendant is facing a one-count charge of defilement. According to the Police Prosecutor, Insp. Chinyere Okechukwu, the accused committed the offence at Umudala village, Nanka community in Orumba North Local Government Area of Anambra.

“On April 18, the girl’s uncle visited the village and took her to Lagos, where he resides, to enable her to continue her education.

“However, during the admission process, the school authorities requested a medical report, which revealed that the girl was HIV positive.

“Upon interrogation, the girl said her father had been sleeping with her since she was 15 years.

“The uncle later returned her to the village in Anambra and confronted the girl’s father, who reportedly admitted to having sexual relations with his daughter and infecting her with HIV.

“The matter was later reported to the police, where the accused admitted he was aware of his HIV status and had been on medication,” she said.

Okechukwu said the offence is punishable under Section 3, 2, of the Violence Against Persons Prohibition and Protection Law of Anambra State of Nigeria, 2017.

She prayed the court to remand the suspect at a Correctional facility as stipulated under Section 130. 2, a, b, of the Administration Criminal Justice Law 2022.

The accused, however, pleaded for mercy, saying it was the devil’s handwork as he had lost count of how many times he had carnal knowledge of his daughter.

The Chief Magistrate, Mrs. U.E. Onochie ordered that the accused be remanded at the Awka Correctional facility.

Onochie adjourned the case until June 17, for hearing.

 In a related development, a Life Camp Chief Magistrates’ Court in Abuja on Thursday, sentenced a 21-year-old barber, Ibrahim Haruna, to three months imprisonment for stabbing his neighbor with a knife.
The police charged Haruna, who resides in Karomajiji Airport Road, Abuja, with causing grievous hurt.
He pleaded guilty to the charge.
Chief Magistrate Musa Jobbo, in his judgment, sentenced Haruna to three months imprisonment and ordered him to pay a fine of N10,000 for causing injuries to his neighbor.
Jobbo warned the convict to be of good behavior and to desist from crimes after serving out his sentence.
Earlier, the Prosecution Counsel, Charity Nwachukwu, told the court that on May 6, the complainant  Mr. Labran Isah of Karomajiji village reported the matter at the Wuye Police Station.
Nwachukwu informed the court that the convict accosted the complainant for no reason and stabbed him in his ribs without provocation.
She told the court that as a result of the stabbing, the complainant sustained grievous injuries.

She said the complainant was rushed to the hospital for medical treatment and spent N107, 000 to treat himself.

The prosecutor said that during police investigation and interrogation the convict confessed to the crime.

The offence, the prosecutor said, contravened the provisions of Section 243 of the Penal Code.
