The Court of Appeal in Abuja overturned previous decisions related to the reinstatement of Muhammadu Sanusi II as the 16th Emir of Kano.

The appellate court, after acknowledging that the case record had been transmitted to the Supreme Court, urged all involved parties to exercise caution while awaiting the apex court’s hearing of their appeals.

In a unanimous ruling delivered by a three-judge panel led by Justice Biobele Abraham Georgewill, the court accepted the Kano State Government’s withdrawal of its application, following the submission of the appeal record to the Supreme Court.

During the hearing, Ibrahim Wangida, representing the Kano State Government, informed the court that a notice of appeal had been filed against the March 14, 2025 stay of execution order.

Wangida confirmed that all necessary legal steps had been completed, including sending the appeal record to the Supreme Court.

As a result, the transmission of the appeal record automatically halted any further action on the Court of Appeal’s ruling of March 14, in line with legal precedents. On that date, Justice Abang had issued a stay on an earlier judgment that had validated Sanusi II’s reinstatement as Emir.

The ruling also called for maintaining the status quo ante bellum, effectively reverting to the situation prior to the June 13, 2024 ruling of the trial court in the matter of Suit No. FHC/KN/CS/182/2024.

Displeased with Justice Abang’s decision, Wangida argued that the ruling misinterpreted constitutional provisions.

He pointed out that the appeal had already been lodged before the Supreme Court.

Responding, Abdul Fagge (SAN), counsel for the appellant, did not object to the notice of appeal, confirming that the respondent had acted in accordance with constitutional requirements.

The Kano State Government had reinstated Sanusi II as Emir following the passage of the Kano State Emirate Council (Repeal) Law 2024, which also resulted in the removal of Aminu Ado Bayero as the 15th Emir.

Bayero, however, returned to Kano under heavy security and is legally challenging his removal by the state government.
