N20 million in damages has been demanded by controversial singer Abdulazeez Fashola, also known as Naira Marley, and Lagos socialite Samson Eletu, also known as Sam Larry, in their lawsuit against the chief magistrate and the police over their detention.
The Lagos chief magistrate, Adeola Olatunbosun, ordered the police to be placed under remand in police custody for a period of 21 days, and the police were named as defendants in the suit filed before the Federal High Court in Lagos.
Remember how Naira Marley and Sam Larry were placed under arrest by the police after they were alleged to have physically assaulted singer Ilerioluwa Aloba, also known as MohBad, after his death?
Sam Larry and Naira Marley are suing the defendants for N20 million in damages each.
They are asking the court to rule that their rights were violated by their prolonged detention “at the Homicide Section of the Lagos State Police Command, Panti, Yaba, Lagos State since October 4, 2023” in a lawsuit they filed through attorney Mr. Olalekan Ojo.
“An order of the court releasing the applicants forthwith” is another thing they are requesting.
“Their travails started between October 3 and 4, 2023 when they were arrested by the police on the alleged connection of the applicants with the death of MohBad,” the deponents stated in the affidavits attached to their suits.
“On the 4th day of October 2023, the Commissioner of Police sought an order in the Magistrates’ Court, held at Yaba to remand them for 30 days.
“However, Chief Magistrate Olatunbosun granted the police application to remand them for only 21 days in the custody of the police.
“The 21-day remand order granted by Olatunbosun has since lapsed on October 26, 2023, and the order has not been renewed”.
No date has been fixed for the hearing of the suit.
MohBad died September 12 at the age of 27 under controversial circumstances.
Thousands of Nigerians have since demanded justice for the late singer in nationwide protests.
