The Court of Appeal in the FCT has upheld the appeal by Hon. Nuhu Akila, the member representing Lau State Constituency at the Taraba State House of Assembly, against Emmanuel George of the APC.
However, the Appeal Court declared the evidence of recounted ballot papers in Lau State constituency as inadmissible and deemed all evidence tendered by the petitioners as incompetent. Hon. Nuhu Akila expressed his elation at the victory, surrounded by supporters and kinsmen.
Recall that the Taraba Elections Petitions Tribunal had earlier overturned the victory of Nuhu Akila and awarded it to Emmanuel George based on the recounted ballot papers in the March 18 elections.
Nuhu Akila of the Peoples Democratic Party , PDP , had been stripped of his victory in the House of Assembly election by the Taraba Elections Petition Tribunal, which is based in Jalingo.
Under the direction of Justice Benson Ogbu, the Tribunal directed that Emmanuel George of the All Progressives Congress , APC, receive the certificate of return from Akila.
Additionally, he declared that all of the petitioners’ evidence was incompetent, that PWs 1 and 2’s testimony was illegal, and that PW 3’s testimony was hearsay.
Surrounded by his kinsmen and supporters, a jubilant Nuhu Akila refused to comment on his win.
However, MP Yerima, a politician and attorney, claimed that God was responsible for the victory. He invited Emmanuel George to work with the victor.
Additionally, he praised Governor Agbu Kefas for his efforts in guaranteeing the party’s victory.
“I call on Emma George to come let’s join hands,” Yerima uttered. He ought to yield to God’s will. He made numerous attempts.
Additionally, Absolom Solomon, a former Special Adviser on Revenue Matters, stated: “The evidence of recounted ballot papers in the Lau State constituency, however, was deemed inadmissible by the presiding judge, Hon. Justice Uche Onyemenam.
