The trial of Adeyemi Ikuforiji, a former speaker of the Lagos House of Assembly, over money laundering charges, faced another delay as Justice Mohammed Liman of the Federal High Court fails to sit.
In a courtroom saga that seems to have more twists than a political thriller, the trial of Adeyemi Ikuforiji, former speaker of the Lagos House of Assembly, encountered yet another setback.
The much-anticipated proceedings hit a roadblock as Justice Mohammed Liman of the Federal High Court failed to preside over the case, leaving both the prosecution and defense in suspense.
This legal rollercoaster began on November 15, the original continuation date of the trial. The courtroom drama had been temporarily halted on the last adjourned date, leading to heightened expectations and tension surrounding the November 20 schedule.
However, Monday proved to be another day of uncertainty as the court was once again void of any legal proceedings. The cause of this unexpected twist?
A letter from the defense counsel seeking an adjournment for the case, with a new date yet to be communicated to the parties involved.
Justice Liman, who has been overseeing the case despite being transferred out of the Lagos division, has added an additional layer of complexity to this legal saga. Despite his relocation, he continues to return to his former division to preside over this high-profile trial, courtesy of a fiat.
Ikuforiji is facing charges of money laundering, standing alongside his former Personal Assistant, Oyebode Atoyebi. The charges allege a whopping N338.8 million misappropriation, which has kept both defendants on tenterhooks since their first arraignment in 2012. The duo entered pleas of not guilty and were allowed to continue on bail granted in 2012.
The trial, which has endured multiple adjournments, experienced a significant development on March 17, 2021. The Economic and Financial Crimes Commission ,EFCC, the prosecuting body, closed its case after presenting two witnesses. It seemed like the trial was inching closer to a conclusion, only to be faced with unforeseen challenges.
Justice Liman’s transfer out of the Lagos division marked a pivotal moment in this legal saga. Despite the setbacks, the defense counsel, led by Mr. Dele Adesina SAN, seized the opportunity to open the case for the defense on May 4, 2023. Overcoming various hurdles, including the transfer of the presiding judge, the defense presented three witnesses, including Ikuforiji himself.
Ikuforiji took the stand, passionately sharing his account of the events leading to the charges. He painted a vivid picture of being prosecuted based on a faceless petition, revealing the alleged theft of about N7 billion from the Lagos House of Assembly. His testimony showcased the human side of this legal battle, emphasizing the personal toll it has taken on him.
Amid the courtroom theatrics, the trial reached the adoption of written addresses, signaling a critical phase in the proceedings. However, the recent series of adjournments, compounded by the absence of Justice Liman, has thrown the legal community and spectators into a state of suspense.
This legal tug-of-war began on March 1, 2012, when Ikuforiji and Atoyebi were first arraigned before Justice Okechukwu Okeke on a 20-count charge bordering on misappropriation and money laundering. The subsequent reassignment of the case to Justice Ibrahim Buba added more complexity, leading to the discharge of the defendants on September 26, 2014.
The EFCC, dissatisfied with the ruling, appealed the decision. The Lagos Division of the Appeal Court upheld the appeal in November 2016, ordering a fresh trial before another judge. The Supreme Court, in its verdict, supported the decision of the appellate court, leading to the current retrial overseen by Justice Liman.
As this legal odyssey continues, it remains to be seen how the twists and turns will shape the final outcome. The defendants, once again, find themselves on the edge of uncertainty, awaiting the next chapter in a story that has captured the attention of legal enthusiasts and the public alike.
