In line with the revised constitution of the Federal Republic of Nigeria and the amended Electricity Act of 2023, the Nigerian Electricity Regulatory Commission, NERC, has announced the transfer of regulatory control over Plateau State’s electricity market.
This responsibility will now be overseen by the Plateau State Electricity Regulatory Commission.
The Electricity Act 2023 maintains NERC’s central role, overseeing inter-state and international generation, transmission, supply, trading, and system operations.
However, the Act also empowers states to regulate intrastate electricity markets, provided they notify NERC and request the transfer of regulatory authority.

In a statement shared on its official X account on Friday, NERC confirmed that Plateau State’s government had met all legal requirements and formally requested the transfer of electricity market regulation within the state.
As part of this transfer, NERC has instructed Jos Electricity Distribution Plc to establish a new subsidiary, JED SubCo, which will take over the responsibility for intrastate electricity supply and distribution in Plateau.
JED is required to complete the incorporation of this subsidiary within 60 days, by March 12, 2025, and to apply for a licence from the Nigerian State Electricity Regulatory Commission,NSERC.
NERC also set a final deadline of September 12, 2025, for the full completion of the transfer process.
With this development, Plateau State joins other states, including Lagos, Imo, Ogun, Ondo, Ekiti, Enugu, Niger, Edo, and Oyo, that have assumed responsibility for regulating their electricity markets.
