Human rights lawyer, Femi Falana, SAN, has filed a lawsuit seeking $5 million in damages against Meta Platforms Inc., the parent company of Facebook, for an alleged invasion of his privacy.
The action, filed at the Lagos High Court, claims that Meta published false information about Falana’s health, specifically stating that he suffers from ‘Prostatitis.’
In the suit filed by his lawyer Olumide Babalola, Falana argues that a video featuring his name, image, and a fabricated narrative about his health condition was posted on the “AfriCare Health Centre” page on Facebook.
He claims the publication is not only false but also constitutes an infringement of his constitutional right to privacy under Section 37 of the Nigerian Constitution and violates the Nigeria Data Protection Act 2023.
Falana contends that the video, which suggests he has been battling Prostatitis for over 16 years, is misleading and unfair, ultimately damaging his reputation and causing emotional distress.

He demands the removal of the video from Meta’s platform and seeks general damages amounting to $5 million for the harm caused by the false publication.
The lawyer, known for his work in human rights and public interest litigation, describes the video as a severe violation of his private life, asserting that the claims made in the video are entirely fabricated.
He emphasizes that the video has been widely circulated and continues to damage his image.
Falana further alleges that Meta published the video recklessly to attract traffic and boost advertisement revenue, without verifying the truth of the claims.
Falana’s legal action aims to hold Meta accountable for its failure to properly vet the content and to seek redress for the emotional and psychological distress caused by the unwarranted exposure.
